Public Financing of Presidential Campaigns: Overview and Analysis

Description: This report discusses current controversies and arguments for and against public financing of presidential campaigns; legislative history; elements of the program; taxpayer and candidate participation; financial status of the program; recent legislation; and analysis of various policy proposals. Election of the President and Vice President by Congress: Contingent Election

Description: The 12th Amendment to the Constitution requires that candidates for President and Vice President receive a majority of electoral votes (currently 270 or more of a total of 538) to be elected. If no candidate receives a majority, the President is elected by the House of Representatives, and the Vice President is elected by the Senate. This process is referred to as contingent election and is the topic of discussion in this report.

House and Senate Vacancies: How Are They Filled?

Description: This report discusses how vacancies in Congress are filled when a Senator or Representative dies, resigns, declines to serve, or is expelled or excluded from either house. The Constitution requires that vacancies in both houses be filled by special election, but in the case of the Senate, it empowers state legislatures to provide for temporary appointments by the state governor until special elections can be scheduled.
